KUALA LUMPUR: The High Court has set Aug 28 for case management of a defamation suit filed by tycoon Tan Sri Eric Chia Eng Hock against DAP secretary-general Lim Guan Eng.
Justice Abdul Wahab Patail set the date after giving both parties two months each to identify issues related to their respective pleadings.
A trial date for the suit will be fixed on the same day if everything is in order, the judge told both parties on Thursday.
Lawyer T. Jegadeeson appeared for Chia while counsel Karpal Singh and Gobind Singh Deo represented Lim.
In the statement of claim filed on Jan 7, 2002, Chia said Lim had caused a police report to be made at the Sentul police station, entitled First Report on Financial Malpractices, Abuse of Power, Corruption and Fraud in Perwaja Trengganu Sdn Bhd.
Chia, who is the plaintiff, claimed that the report was calculated to disparage him as he was then the managing director of Perwaja and all of its subsidiaries.
The plaintiff further claimed that the report implied that he was dishonest and had acted in a manner detrimental to the interest of the company.
Chia said he was also portrayed as corrupt, unfit to serve the company and had acted in conflict of his duties.
He sought an order from the High Court prohibiting the defendant from writing, printing, publishing and/ or circulating the contents of the said report with the intention of defaming him.
He is seeking damages, costs and further relief deemed fit by the court.
Lim, who is the Penang Chief Minister, said he would rely on the defence of qualified privilege.
In his statement of defence filed in 2002, Lim said his comments were reasonable in view of public interest and were made in his capacity as a Member of Parliament then.
